Technical consultation on PAYE Regulations

Your views count – have your say on Income Tax (Pay As You Earn) Regulations 2017 (draft legislation), only open for comment until Tuesday 28 November.

A technical consultation has been published which seeks comments on draft PAYE Regulations in respect of Car Data Reporting Requirements and Reporting Taxable Amounts due under Optional Remuneration Arrangements.

For those of you who voluntarily payroll company cars as a Benefit in Kind (BiK), you will from April 2018 have to payroll your car data. It will be mandatory from this time to submit your car data information on your FPS (Full Payment Submission).

This only applies to those who have chosen to voluntarily payroll company cars as a BiK; it does not apply to all employers who provide company cars – you can continue to process in the normal way via P11D and P46 (Car).

Changes are required to the Pay As You Earn (PAYE) Regulations 2003 from April 2018 as a consequence of policy measures relating to Voluntary Payrolling and Optional Remuneration Arrangements originally announced at Budget 2014 and Autumn Statement 2016 respectively.

The consultation on the changes to legislation is only open for comments until 28 November 2017. With such a short window the CIPP Policy team would ask that individuals wishing to provide feedback do so either:
