Alan Muir MCIPPdip - went on to become one of the first two tutors in Scotland. Since then, apart from continuing to be a tutor he has performed a number of roles for the institute, serving as our representative on some of the government consultation panels in Scotland.

Vince Linnane - has been an advocate for pensions for over 30 years, working for the Pensions Management Institute in various capacities for 32 years, the latter ten as their former chief executive.  In 2016 alone he has been awarded the Professional Pensions lifetime achievement award, and the Pensions Age pension’s personality of the year.

FAQ testing

How comprehensive is PAS?

Early in the process we will provide you with a checklist which identifies 14 categories which will be assessed; within these categories there are around 60 sub-elements. These elements have been put together based on experiences gained by our consultants in payroll and taxation roles, and we believe that this creates a comprehensive review of any payroll operation, whether that be in-house or a managed payroll service. The focus of the Payroll Assurance Scheme (PAS) is to verify that processes are in place to ensure accurate payments to payees but also to ensure that appropriate deductions are made from employees pay and are accounted for to HMRC and other authorities. The assessment will also test the readiness of the employer to assimilate major legislative changes in addition to regular changes such as at tax year changes.

A company is being TUPED - do we have to honour the employees who had already been automatically enrolled?

For any transferred-in employees that were already members of a pension scheme (possibly as a result of the old employer having automatically enrolled them, although they could have been contractually enrolled), the new employer will need to provide them with a similar pension scheme to fulfil their TUPE obligations. 1. If the acquiring company has reached their staging date, any employee who is TUPE’d to another organisation is treated as a new joiner for automatic enrolment purposes (all history with respect to opting in or opting out, whilst working for the old employer, would be disregarded by the new employer). For a given transferred-in employee, the new employer could either: • Use contractual enrolment to ensure that the employee is an active member of a qualifying scheme at the point of assessment (ie on joining or when they first trigger automatic enrolment after joining, or at the end of postponement if used); or • For those who meet the age and earnings criteria (ie are an eligible jobholder), automatically enrol them into an automatic enrolment scheme. In either case, they would need to be enrolled into a pension scheme which also satisfies their TUPE obligations. 2. However, if the acquiring employer had not yet staged then they only have to meet their TUPE obligations - until they reach their staging date.At their staging date, the new employer will need to assess all their workers and automatically enrol those who meet the criteria. Note that if the pension the new employer had used to fulfil their TUPE obligations is a qualifying scheme then, on their staging date, any employees previously transferred-in from the old employer, who are still active members, would be assessed as being ‘active members of a qualifying scheme’ and so no duties would apply to them. However, if any scheme used to fulfil the TUPE obligations was not a qualifying scheme, then the employer would need to automatically enrol any scheme members who meet the age and earnings criteria into an automatic enrolment scheme. You may also need to seek further advice from an employment law specialist to ensure that benefits already in place are taken account in the due diligence process prior to the TUPE effective date.
