The UK Government has opened a formal call for evidence on the Transfer of Undertakings (Protection of Employment) Regulations (TUPE), inviting views from employers, employees, HR professionals, unions and legal specialists.

The review aims to assess whether TUPE remains fit for purpose in today’s labour market and whether reforms are needed to improve clarity, fairness and efficiency, as part of their plan to Make Work Pay.

 

The consultation is aiming to understand:

  1. Is TUPE too complex or unclear?
  2. Are employees genuinely protected, or are there loopholes?
  3. Are employers overburdened by cost and process?
  4. Are economic, technical and organisational (ETO) reasons and contract-variation rules too flexible or too vague?
  5. Is guidance on GOV.uk and ACAS insufficient?
  6. Are there equality impacts that haven’t been considered?
