Following the Neonatal Care (Leave and Pay) Act 2023 receiving royal assent on 24 May 2023, HMRC's Software Developer Support Team are working in the background to ensure Real Time Information (RTI) and its supporting systems are ready for the new statutory allowance which is planned to be introduced as early as April 2025, or as soon as practical.

Please note this update is for a planned implementation in April 2025, but a formal implementation date had not yet been confirmed. Once we are aware of the implementation date, the policy team will let you know. 

Who is Neonatal Leave for?

The Act is for parents who have a child that requires neonatal care in the first 28 days following birth, to recieve up to 12 weeks of Statutory Neonatal Pay and Leave. 

Payment is due to follow the same administration process as other statutory payments, such as Statutory Parental Bereavement Pay & Leave. The payments will be paid out by employers and claimed back through payroll processes (EPD).
 

When Does Entitlement to Statutory Neonatal Care Pay & Leave Begin?

The introduction of Statutory Neonatal Care Pay and Leave will be available to employees from the first day of their employment, and will apply to England, Scotland and Wales.
