Following consultations of the draft code of practice, the Department for Work and Trade (DBT) has published the full statutory guidance on dismissal and re-engagement.

The code aims to protect employees from so called, ‘fire and rehire’, a practice that some employers have used to change employees term and conditions.

Employment tribunals have been given the power to uplift any compensation awarded by 25% if the employer is found to have unreasonably failed to comply with the code.
