The Advisory Service has received several queries from members regarding a nuance regarding Statutory Sick Pay (SSP) since the changes from 6 April 2026. 

The reoccurring query we are receiving is: 

 

“Employees, not new starters, who have zero average weekly earnings (AWE) in the relevant period, are still not entitled to SSP. However, there is no option on the new SSP1 form to state this. Can you expand on what employers should do in this instance please?” 

 

The policy team reached out to their contacts at the Department of Work and Pensions to query this, and received the following statement: 

 

“The Department is currently investigating the issue and will issue advice shortly.”
