The Department of Business and Trade (DBT) has released non-statutory guidance for employers on how to follow the code of practice on the fair and transparent distribution of tips ahead of the new legislation coming into force on 1 October.
The guidance:
- Applies to all business and industries where the workers receive tips
- Intends to help employers understand and apply the code of practice
- Is not legal advice
- Is not an exhaustive record of what is within acceptable limits of the code of practice or the Employment Rights Act 1996
This guidance is planned to support employer’s assessment of troncmaster’s decisions, where a troncmaster is used to operate the scheme.
Where employers are unsure of their obligations, they should always seek independent legal advice.
